Welcome to bendr.ai. These Terms of Service ("Terms") govern your access to and use of the bendr.ai platform, website, and services (collectively, the "Service") operated by Bendr bv ("we", "us", or "our"), a company registered in Belgium. By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using bendr.ai, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

bendr.ai is an intelligent AI platform that provides tools for content creation, business intelligence, automated customer interactions, and workflow automation. Our services include but are not limited to:

  • AI-powered intelligence engine for data analysis and insights.
  • Content architect tools for automated content generation.
  • AI chatbot solutions for customer engagement.
  • Integration capabilities with third-party platforms and APIs.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activities that occur under your account.

You must notify us immediately at hello@bendr.ai if you suspect any unauthorized access to your account.

4. Free Trial

We offer a free 14-day trial of our Service. At the end of the trial period, your account will be automatically downgraded to a limited free tier unless you subscribe to a paid plan. We reserve the right to modify or discontinue the trial offer at any time.

5. Subscription and Payment

Paid plans are billed on a monthly or annual basis, as selected at the time of subscription. All fees are stated in euros (EUR) and are exclusive of applicable taxes unless otherwise indicated.

  • Payments are processed securely through our third-party payment provider.
  • Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
  • Refunds are handled on a case-by-case basis. You may request a refund within 14 days of your initial paid subscription.
  • We reserve the right to change our pricing with 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Transmit harmful, threatening, abusive, or otherwise objectionable content.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Use the Service to generate spam, misleading content, or disinformation.
  • Reverse-engineer, decompile, or disassemble any part of the Service.

7. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by Bendr bv and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to or create through the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you. We do not claim ownership over your content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Bendr bv shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

You may terminate your account at any time by contacting us or using the account settings in the platform. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms.

Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination. After this period, we may delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on our platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
